Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Noémie Noire: the sole proprietorship operating under the name Noémie Noire, established in the Netherlands, registered with the Dutch Chamber of Commerce under number 75838877.
  • Webshop: the online store operated by Noémie Noire.
  • Customer: any natural person acting as a consumer.
  • Agreement: any agreement concluded between Noémie Noire and the customer.
  • Products: lingerie, erotic lingerie and accessories offered via the webshop.

Article 2 – Applicability

  1. These terms and conditions apply to all offers, orders and agreements between Noémie Noire and the customer.
  2. Deviations from these terms are only valid if agreed upon in writing.
  3. By placing an order, the customer agrees to these terms and conditions.

Article 3 – The Offer

  1. The offer includes a clear and accurate description of the products.
  2. Images are for illustrative purposes only and may differ slightly from the actual product.
  3. Obvious errors or mistakes in the offer do not bind Noémie Noire.

Article 4 – Conclusion of the Agreement

  1. The agreement is concluded at the moment the customer completes the order and receives an order confirmation.
  2. Noémie Noire reserves the right to refuse orders or request additional information.

Article 5 – Prices and Payments

  1. All prices in the webshop are displayed in euros (€) by default and include VAT, unless explicitly stated otherwise.
  2. Noémie Noire reserves the right to display prices in other currencies.
  3. If prices are shown in another currency, the price in euros shall always be decisive. Converted amounts are indicative only.
  4. When paying via external payment providers, exchange rates and rounding differences may occur. Noémie Noire is not responsible for discrepancies resulting from this.
  5. Any shipping costs will be clearly stated before the order is completed.
  6. Full payment must be received before shipment takes place.

Article 6 – Delivery

  1. Orders are shipped to the address provided by the customer.
  2. Delivery times are indicative and may vary.
  3. In exceptional cases, products may be shipped directly by an external supplier. This will always be clearly stated on the product page.
  4. Exceeding a delivery time does not entitle the customer to compensation.

Article 7 – Right of Withdrawal

  1. The customer has the right to withdraw from the agreement within 14 days after receipt of the product.
  2. Within this period, the customer must notify Noémie Noire in writing via
    secrets@noemie-noire.nl.
  3. Products must be returned unused, undamaged and, where reasonably possible, in their original packaging.

Article 8 – Exclusion of the Right of Withdrawal (Hygiene)

  1. The right of withdrawal is excluded for products that, by their nature, are not suitable for return for reasons of health protection or hygiene, and whose hygiene seal has been broken after delivery.
  2. The right of withdrawal is also excluded for products that have been worn, used, fitted beyond what is necessary to assess the product, washed, damaged, or altered in any way.
  3. This exclusion applies in particular, but is not limited to:
    • ingerie and erotic lingerie;
    • intimate apparel;
    • pasties, nipple covers and similar accessories;
    • all products intended for direct contact with intimate body parts.
  4. Fitting lingerie is permitted only to the extent necessary to assess size and appearance. Any use beyond this, including contact with intimate areas or the removal or breaking of hygiene seals, results in the loss of the right of withdrawal.
  5. Returned products that do not comply with the above conditions will not be accepted and will not be refunded.

Article 9 – Returns

  1. Returns are made at the customer’s own risk.
  2. Return shipping costs are borne by the customer, unless otherwise agreed.
  3. Refunds will be processed within 14 days after correct receipt and inspection of the returned product.

Article 10 – Liability

  1. Noémie Noire is not liable for indirect or consequential damage.
  2. Liability is limited to the amount paid for the relevant order.
  3. Use of the products is entirely at the customer’s own risk.

Article 11 – Force Majeure

  1. Noémie Noire is not obliged to fulfil any obligation if prevented by force majeure.
  2. Force majeure includes circumstances beyond the control of Noémie Noire, such as delays caused by carriers or suppliers.

Article 12 – Privacy

  1. Personal data is processed in accordance with applicable privacy legislation (GDPR).
  2. Please refer to the privacy policy available on the webshop.

Article 13 – Complaints

  1. Complaints must be submitted in writing within a reasonable period via
    secrets@noemie-noire.nl.
  2. Noémie Noire aims to respond to complaints within 14 days.

Article 14 – Applicable Law and Disputes

  1. All agreements are governed exclusively by Dutch law.
  2. Disputes shall be submitted to the competent court in the Netherlands.
